The broadcaster on ESPN would be covered because he gave his opinion and a general opinion without any threats or incitement.

A broadcast of Steph Curry’s daughter would still not qualify for defamation for similar reasoning before. You cannot prove that Steph Curry’s daughter is a brat which makes the comments a true opinion and cannot form the basis of a defamation claim (“Opinion”, n.d.).

Unfortunately, as much as I dislike Alex Jones, I think his statement of comparing himself to a creep and how his audience knows him is the same as if he were to say he’s joking. He’s acknowledging that he should not be trusted and those listening know not to trust what he is saying as fact. Even if his audience does believe him, Alex Jones does not have enough power to completely shift public opinion on what actually happened in Sandy Hook.

What is the essence of opinion/fair comment and might that be a defense here if Curry can make out a prima facie case (the elements) of defamation? (yes there’s the rub and the hint…as these can be interchangeable as stated about…are we talking about falsity here?)

I personally do not think Steph Curry could win the case because he’s a public figure and his family is used to endorsing products. Even though the daughter is not the main person in the spotlight, she is the daughter of Steph Curry so she maintains some level of publicity. Also, SNL is the type of show that is full of satire so they are going to joke around and voice their opinion on people and situations. Therefore, I do not believe that there is a case regarding defamation. There would be no definite evidence of defamation and what was said was “too vague to be capable of being proven true or false” and had “no generally accepted meaning.” (Opinion and Fair Comment Privileges, n.d.).

2. If this was “Weekend Update” on NBC’s SNL and Colin Jost and Michael Che were showing endless clips of the little girl foisted in the limelight and acting out, etc etc and Che said, “Now if this ain’t a damn brat I’m Jay Pharoah.” And Curry sues Comcast-Universal…again, is this even defamation?

Considering that SNL is a comedy show, I do not believe Steph Curry would be able to prove this case as defamation. The basis of the news and the stories they give are mainly based on entertainment purposes which also displays opinions. It this were on SNL’s Weekend Update there would be no defamation at all. Saturday Night Live has been a comedy show dating back all the way back to 1975, SNL throughout its history have always made funny of all events that are currently going around the world. The case for defamation wouldn’t hold up in court for Steph Curry.

3. OK, but what about this: Not “I was just kidding,” but “I am a creep… I and perhaps my audience knows this?” Re: Sandy Hook and Alex Jones…

I don’t believe what Alex Jones did is considered defamation. What he said may have been unethical but from but being insulted by what someone is saying would not justify warranting defamation. Individuals have a difficult time believing anything he says because what he says is false and is not backed up by facts.
